  • "Developer" - An individual or entity seeking to purchase land for development purposes.
  • "Legal Fees" - The costs associated with legal processes in land transactions, which Capital Grounds Ltd may cover up to £1500 plus VAT.
  • "Option Agreement" - The legal agreement between Capital Grounds Ltd and the landowner, setting the fixed offer price and granting Capital Grounds Ltd the exclusive right to facilitate the land sale.
  • "Planning Permission" - The formal approval required from local authorities for land development or change of use.
  • "Transaction" - The process of selling land under an Option Agreement, including planning, legal and contractual stages.

3. Services Provided
Capital Grounds Ltd offers land consultancy services including land sourcing, assessment and planning support. Our team works with landowners, developers and industry professionals to maximize land value and facilitate smooth transactions. As detailed on our website, we provide landowners with a comprehensive service at no cost to them. We manage the land planning process including land assessments, planning applications and liaising with all the relevant authorities. Additionally, we cover associated costs including legal fees up to £1500 plus VAT, ensuring a smooth process for landowners.

4. Client Responsibilities
Clients engaging with our services must provide accurate information regarding their land and cooperate with our team in facilitating the necessary processes. Any obligations or agreements will be clearly outlined in writing before engagement. Landowners engaging with Capital Grounds Ltd agree to provide necessary access to their land and to collaborate on required planning processes. While our services are free, landowners must cooperate with any reasonable requests in order to facilitate the planning and sale process.

5. Legal Fees
Capital Grounds Ltd covers the legal fees of landowners up to £1500 plus VAT as part of our commitment to facilitating a seamless transaction. Any legal costs beyond this amount remain the responsibility of the landowner, unless otherwise agreed in writing.

6. No Guarantee of Planning Success or Timeline
While we leverage our expertise to secure the best possible outcome for our clients, we do not guarantee that planning permission will be obtained or that it will be achieved within a specific timeframe. Delays may arise due to regulatory approvals, unforeseen legal challenges or other external factors beyond our control.

7. Fixed Offer Price
The offer price for landowners is agreed upon before the option agreement is signed and remains fixed as per the terms of that agreement.

8. Limitation of Liability
Capital Grounds Ltd is not liable for any loss, damage or unforeseen circumstances arising from planning refusals, regulatory delays or other external factors beyond our control. Clients should seek independent legal or financial advice as necessary.

9. Confidentiality
The terms of our business arrangements remain confidential and will not be disclosed.

10. Amendments to Terms
We reserve the right to amend these Terms of Service at any time. Any changes will be updated on our website and landowners will be notified where applicable.

11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising will be resolved under the jurisdiction of the courts of England and Wales.
